Legal Agreement: Terms of Service

1 – About / Ethos

 

Bricks is a coworking space located on the first floor of the Hathaway Creative Center in Waterville, Maine. Our goal is to provide a high-quality work space for members of all backgrounds and careers.

With that, we have some requests of you:

A) Be Friendly

Talk to your fellow members, have lunch together or grab a coffee, make everyone feel welcome. This also means if you see someone looking to tour or check out Bricks, show them around. If someone is new to Bricks, introduce them to others.

B) Be Helpful

Our hope is that Bricks not only gives members a space to work, but also helps to cultivate innovation and a space for members and their business to prosper and grow. With that, be helpful; talk to them about what you do, listen to their concerns or issues and offer advice.

C) Be Respectful

With Bricks being a shared workspace, you’re going to be working in close quarters with many other members that may not work the same way as you. Please be respectful with your conversations, music, and overall, be a good neighbor!

D) Be Cleanly

Again, as this is a shared space, any mess left is a mess other’s either need to deal with or clean up. Please clean up after yourself, or others when necessary, and help to keep Bricks a clean and fun place to work and collaborate.

E) Do great work.

Others are here to help you. Please reach out to rj@brickscoworking.com for any assistance. Materials and resources are always readily available within the office for business development and assistance, and other community assistance that you may want or need. 

When it comes down to it, just:

  • Treat others as you want to be treated.
  • Treat the office space as if it were your own, because it is!

2 – The Space

A) Workspaces

There are three levels of workspace within Bricks:

  • Floating: A seat at a table, no reservation, just grab a spot every day when you come in. You have access to most of the Bricks’ amenities.
  • Dedicated: Your own desk (sit-stand), filing cabinet, and a bit more stuff from Bricks. Make your desk your own!
  • Office: A desk and filing cabinet, plus four walls to keep your space a bit more private! Along the lines of the Dedicated Desk, you also have added benefits.

 B) Meeting Space

Monthly members of Bricks have access to the meeting room within Bricks. Each membership level is given an amount of hours to use each month. These hours expire each month (cannot be rolled over).

  • Floating: 8 hours / monthly
  • Dedicated: 12 hours / monthly
  • Office: 16 hours / monthly

[Cancellation / No Show] Failure to cancel your meeting room booking with 12 hours of the start time will result in the loss of those scheduled hours. The same applies for a ‘no show’ on your booking time.

[Buying more] Additional hours are available to members at the rate of $20 / hour. Please contact rj@brickscoworking.com to learn more or request more hours.

[Guaranteed Availability] We cannot guarantee availability of meeting space. We will, however, do our best to help accommodate your needs in the event the space is full. Please contact rj@brickscoworking.com or bricks@brickscoworking.com for assistance.

C) Access

As Bricks is locked at all times, it’s important you understand how to access the space.

All memberships will be provided key cards/fobs that can be used to access the space. Just tap your card against the sensor on the front door, and you’ll be granted access (light will blink green).

[Lost of Card] A $10 fee will be charged upon the loss and re-issue of an access card (essentially replacing your initial deposit).

[Termination / Cancellation] It is expected that upon termination, you immediately return your access card. Upon return, your deposit will be returned.

 D) Internet 

Wireless Internet is provided throughout Bricks. If you have any issues connecting to the WiFi, please contact rj@brickscoworking.com or bricks@brickscoworking.com. 

While we do everything we can to provide quality internet speeds, occasional outages are always possible. We do apologize for any inconvenience, however we do not provide any type of refund or compensation to members for any type of interruption or downtime caused by our Internet Service Providers. 

 E) Cleaning

Bricks is cleaned on a regular basis; generally, every weekend. This cleaning includes:

  • o Empty trash bins
  • o Sweep / Vacuum all office space
  • o Clean kitchen countertops
  • o Run the dishwasher
  • o Restock kitchen items

The standard cleaning DOES NOT include:

  • o The cleaning of dirty cups, mugs, dishes, silverware, etc.
  • o The cleaning of desktops

Please be considerate as members of the space.

  • o Either wash your cups/dishes, or put them in the dishwasher before the evening cleaning
  • o Keep your desktop countertops clean
  • o Cleanup after yourself in shared areas (kitchen, dining area, lounge area, meeting room)

 F) Printing / Copying

Located within the space is a Dell multi-function printer (printing, copying). This printer is available while on the Bricks network.

Bricks provides black toner, as well as paper. This multi-function printer is expected to be used for small jobs; please use your best judgement and let us know if you need assistance/recommendations on larger jobs. If a member is abusing the use of the printer, action may be taken.

 G) Guests

Guests are allowed at Bricks, however please use your best judgement as to not cause distractions or issues for other members. It is preferred that meetings and interactions with guests are done in meeting spaces. More to come on this. 

 H) Pets

Pets are not allowed at Bricks at this time.

 

3 – Membership

 

 A) Payment

We accept payment via credit card or ACH using the Proximity coworking space web platform. Payment first occurs upon membership start date / sign up, and then recurs automatically on the first of the month every month until your membership is cancelled or terminated. You explicitly agree that we have authorization from you to charge your credit card on a recurring basis.

 If you start on a day other than the 1st of a month, that’s month’s charge will be prorated. 

A $10 deposit will also be taken upon sign up for your access card (details in the Access section).

[Failure to Pay]  A member’s failure to pay overdue invoices within 10 days of the 1st of the month will result in termination of membership and forfeiture of deposit.

 B) Cancellation

While we do encourage month-to-month contracts (you will be billed automatically monthly upon signup if choosing a month-to-month plan), 30 day’s notice is required for cancellation. Notice of cancellation must be provided via email to either rj@brickscoworking.com or bricks@brickscoworking.com.

 C) Termination

Failure to follow the guidelines and conditions laid out in this document could result in the membership termination. 

We reserve the right to terminate a membership at any time, both without notice and without a refund.

 D) Liability 

Indemnification and Release of Liability. In consideration for receiving permission to use the Bricks Coworking space, you RELEASE, WAIVE, AND DISCHARGE, and agree to INDEMNIFY AND HOLD HARMLESS Bricks Coworking LLC, its officers, agents, or employees (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you or your guests, or to any property belonging to you or your guests, while in or on the premises, IF SUCH LOSS IS CAUSED BY YOUR ACTION, INACTION, OR NEGLIGENCE and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law.

You voluntarily assume full responsibility for any risks of loss, property

damage, or personal injury, including death that may be sustained by you or your guests, or any loss or damage to property owned by you or them IF CAUSED BY YOUR OWN OR YOUR GUESTS’ ACTIONS, INACTIONS, OR NEGLIGENCE, to the fullest extent allowed by law.

Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Maine. The parties consent to exclusive jurisdiction and venue in the federal and state courts sitting in Augusta, Maine.

 E) Term Modifications

We may change these Terms and Conditions at any time. If the changes we make are material, we will notify you via your provided email address. By continuing to use Bricks after these changes becoming effective and you being notified, you agree to the revised Terms and Conditions.
